NEW MOTOR VEHICLES (AMENDMENT) ACT 2019


The central Govt has introduced the implementation of New Motor Vehicles Act from 01 Sep 2019. The aim of the Act is to regulate the vehicle plying on the roads to follow laid down traffic rules. The amendment was necessitated due to increase in number of accidents which resulted in 1.5 lakh deaths last year. A major reason for violation of traffic rules was nominal penalty for the defaulters. Thus, the govt. has increased penalties for violators of offences. The Amended Act has increased penalties 5 to 10 times for offences, penalising parents if the vehicle is driven by the minors, heavy penalty for pollution by ensuring a mandatory certificate for pollution under control.

Is the Act with high penalties justified?

A number of people were challaned in the first week and heavy fines were imposed. Some people criticized the move with heavy penalty on the common man. But the aim of the bill is to follow the traffic rules and protect the environment. The people used to break the rules and get away by giving nominal fine. This will not happen now on. The penalty has been increased 5 to 10 times, Cancellation of license and even imprisonment. The enhancements of fines are justified due to the following reasons:


  1. Saving Lives 1.5 Lakh people were killed in fatal accident last year. The defaulters were drunken drivers, driving without helmets, jumping red light and exceeding speed limit with increase in penalties, the people will he more conscious and valuable lives would be saved.
  2. Discouraging Minors Many accidents were caused by ‘Minor Drivers’. There were hardly any penalties for defaulters. Now the parents of the minors will be penalised for giving vehicles to the minors. This will cut down the number of accidents and save many precious lives
  3. Protecting Environment Petrol and diesel vehicles are the biggest contributor of population. As the implementation of getting the vehicles checked for pollution was poor, by enhancing penalty for non-implementation will save the environment.
  4. Sense of Discipline among public Enhanced penalty will help to inculcate sense of discipline among the masses. There is total lawlessness on the road.
  5. Improving India’s image The tourist are the best ambassadors for any country. Once they see the disciplined traffic, they will get impressed and improve the image of a country.
Points against the steep hike in fines

There is no dust that to save the human life and having a disciplined traffic is the top priority for the govt of the day. People must pay for any violation of law/traffic rules. But enhancement of penalties, 5 to 10 times from the existing rates, has created harness among the public. Therefore enhancement of fines will have the following repercussions:


  1. Pinches the Average people Sometimes, the violation of traffic rules is not intentional. The poor drivers of cabs, autos, trucks and public transport suffers when they have to pay heavy fines.
  2. A boost to corruption When a defaulter is challenged for any lapses he will try to bribe the traffic police. As the amount of challan is too high, the amount of bribe proportionally increases.
  3. Drivers may lose jobs When a hefty amount is enforced as challan, the owners of the vehicles, will throw their drivers out from the job. Drivers may lose their pay for a month/Two months from the owners of vehicles.
Suggestions

There is no doubt that approximately 400 valuable lives are lost in accidents every day. There was a need to put the traffic on roads in a disciplined manner. The govt. enhanced the penalty for the defaulters to put a sense of fear among the public. However, it is recommended that the steep hike in penalty should be received for the offense, as some of the challans have exceeded from the lost of the vehicles. More print, electronic and social media for running of smooth traffic on roads. Responsible citizens should be invited to give their suggestions. More NGOs should be roped in to educate and motivate the people for their safe driving on the roads. The govt should also improve the road conditions, lighting system on the roads to avoid accidents. Technology should be used, like cameras to cut down corruption. The aim of the bill to save the lives, environment and future of the citizens is appreciated but the steep hike in fines will hit the average man and their families.
